1. Introduction

Welcome to My Meals ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our mobile application ("App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our App.

2. Eligibility

You must be at least 13 years old to use our App. By using the App, you represent and warrant that you have the right, authority, and capacity to enter into these Terms.

3. Account Registration

To access certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are responsible for safeguarding your password and other login credentials. You agree to notify us immediately of any unauthorized use of your account.

4. Use of the App

4.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms.

4.2 Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any local, state, national, or international law.
  • Attempt to gain unauthorized access to any part of the App, other user accounts, or computer systems.
  • Use any automated means to access the App for any purpose without our express written permission.
  • Interfere with or disrupt the integrity or performance of the App.
  • Upload, post, or transmit any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.

5. User Content

You retain ownership of any content you submit, including recipes, photos, and other materials ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content within the App and for promoting the App.

You are solely responsible for your User Content and the consequences of submitting it. We reserve the right to remove any User Content that violates these Terms or is deemed inappropriate.

6. Intellectual Property

All intellectual property rights in the App and its content are owned by or licensed to us. You agree not to reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the App without our express written permission.

7. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

8. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the App;
  • Any unauthorized access to or use of our servers and/or any personal information stored therein;
  • Any bugs, viruses, trojans, or the like that may be transmitted to or through our App by any third party;
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.

Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you have paid us, if any, in the past six months for accessing the App.

10. Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees and costs, arising out of or in any way connected with your access to or use of the App, your User Content, or your violation of these Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Berlin, Germany.

12. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the App.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.

14. Entire Agreement

These Terms constitute the entire agreement between you and us regarding your use of the App and supersede all prior agreements, understandings, and representations regarding the same.

17. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
